Privacy Policy

This Privacy Policy explains how messmo Pty Ltd (ACN 128 169 988) safeguards and uses information when providing the messmo application and services.

What Information Does messmo Collect and What is it Used For ?

messmo collects three types of information

  1. Information that you provide when downloading messmo and activating the service. Such information includes but is not limited to your mobile number, handset make, handset model, country of use and mobile operator. It also includes additional information that you may provide when communicating with messmo, for example with a support query.
  2. Information based on your usage patterns. This information is often generated automatically when you are using messmo and is aggregated across the messmo user base for the purpose of enhancing the messmo service.
  3. Information that you create when exchanging messages or using a messmo service with other users. This may include information about the destination of a messmo message. This information is never disclosed and is solely used to enhance messmo services, as well as block malicious or fraudulent use of messmo. messmo does not retain the specific content of your personal messages other than if needed by delayed delivery and to provide you with your message history.

The collected information enables messmo to:

  1. Enhance the messmo services
  2. Communicate with you re any version upgrades.
  3. Communicate with you re support queries
  4. Block malicious or fraudulent use of messmo
  5. Ensure compliance with the messmo Terms and Conditions.

If you object to providing the collected information then messmo will not be able to provide you with the messmo application and services.

Third Party Access to Information

messmo will only ever provide access to individually identifiable information when:

1.       you consent to sharing such information;

2.       messmo has reason to suspect that unlawful activity has been, is being or may be engaged in, and uses or discloses the collected information as a necessary part of its investigation of the matter or in reporting its concerns to relevant persons or authorities;

3.       messmo is required by court order or law;

4.       if needed as a result of contravening the messmo Terms and Conditions of service;

5.       if messmo has engaged a 3rd party to provide services to users on behalf and as an agent of messmo, messmo may provide users records, however messmo will ensure that the 3rd party is bound by the terms of this Privacy Policy; or

6.       otherwise in accordance with the National Privacy Principles (“NPPS”).

messmo will not sell individually identifiable information to 3rd parties.

In the event that messmo or any subsidiary is acquired or merged with another entity messmo will take all reasonable efforts to ensure that the other entity implements a comparable Privacy Policy, however messmo reserves the right to transfer all of its data, including user data to the other entity as part of such a transaction. messmo will notify you via the messmo website.

Other Information

messmo will not collect other information about you, or your mobile device, or your mobile operator, other than that required to provide an improved messmo service.

Access to Information

If you would like further information about the details that messmo has collected about you and/or if you want to request access to such details, please contact messmo via the contact details below.  messmo reserves the right to withhold such details in accordance with its rights and obligations under the NPPs.

Cookies

For added convenience, we have employed a "cookie" system for the messmo website. A "cookie" is a small file placed on your PC which lets messmo store information. This information allows messmo to provide you with an enhanced user experience. The information stored by the cookie includes the data that is provided during posting a support query. This information is only accessible online when you enter your mobile number and password. The use of cookies is common on major websites and most web browsers are set to accept cookies.

You may set your browser to refuse cookies but this may mean that you will not be able to take full advantage of the features available on the messmo website.

Software Updates

messmo on your handset may advise you of a more recent version of the messmo software. messmo will however ask you to agree prior to installing a more recent version. messmo may however update control files and provide maintenance fixes to the software without asking you.

Storage of Information

Information collected by messmo is stored on an electronic database system held on secure servers located in access-controlled facilities. The database system contains security features to protect customer information. Our staff are required to maintain user confidentiality.

Loss of Handset or Password

If you lose your handset or your password then you must contact messmo immediately.

Policy Amendments

From time to time, this Policy may be amended. messmo reserves the right to change its Privacy Policy at any time. An updated version of the policy will be accessible on the messmo website. It is your responsibility to regularly check the messmo website for any amendments to the Privacy Policy. Usage of the messmo website is deemed as acceptance of the Privacy Policy and any subsequent amendments.
